Please read these Terms carefully before using OneBiz. They govern customers and visitors. If you list a business, the Business Terms of Service also apply to your listing account.
01Acceptance of Terms
By accessing or using the OneBiz platform as a customer or visitor (the 'Service'), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you must not use the Service. Business owners who list on OneBiz are also bound by the separate Business Terms of Service.
02Description of Service
OneBiz is an online marketplace that connects consumers with independent service providers across Greater Sydney. OneBiz acts solely as an intermediary; we do not employ, endorse, or act as agents for any provider listed on the platform. We do not provide legal, migration, financial, tax, medical, or any other form of professional advice.
03Eligibility
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use this Service. By using the Service, you represent and warrant that you meet these requirements. Users under 18 may only use the Service with the supervision and consent of a parent or legal guardian.
04User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, complete, and current information during registration and keep it updated. You must notify us immediately at support@onebiz.com.au if you suspect unauthorised use of your account. OneBiz reserves the right to suspend or terminate accounts that provide false or misleading information.
05Provider Responsibilities
Business providers are solely responsible for the accuracy of their listings, credentials, qualifications, pricing, availability, and service descriptions. Providers must hold all licences, registrations, and insurances required by Australian law for the services they offer. Providers must not misrepresent their business, qualifications, or the services they deliver.
06Consumer Responsibilities
Consumers must use the platform in good faith and engage with providers respectfully. Consumers must not submit false, misleading, or defamatory reviews. Enquiries and booking requests must reflect genuine intent to engage services. Any dispute arising from a service engagement is between the consumer and the provider.
07Reviews and Content
Reviews and content submitted on OneBiz must be genuine, accurate, and based on real interactions. You must not post content that is false, defamatory, discriminatory, offensive, or in violation of any third-party rights. OneBiz reserves the right to remove content that violates these standards without notice. Users who repeatedly submit false or abusive content may be permanently banned.
08Prohibited Conduct
You must not: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the platform; (c) scrape, copy, or reproduce any content without written consent; (d) interfere with or disrupt the integrity or performance of the Service; (e) impersonate any person or entity; or (f) engage in any conduct that restricts or inhibits any other user's enjoyment of the Service.
09Intellectual Property
All content, trademarks, logos, and intellectual property on the OneBiz platform are owned by or licensed to OneBiz Pty Ltd. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for its intended purposes. You must not reproduce, distribute, or create derivative works without prior written consent from OneBiz.
10Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, OneBiz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to damages arising from disputes between consumers and providers. Our total liability to you for any claim shall not exceed the amount, if any, you paid to us in the 12 months preceding the claim.
11Dispute Resolution
In the event of a dispute, you agree to first attempt to resolve it informally by contacting us at support@onebiz.com.au. If the dispute cannot be resolved within 30 days, either party may refer it to mediation through the Australian Disputes Centre before pursuing any other legal remedies. Nothing in this clause limits any rights you may have under the Australian Consumer Law.
12Termination
OneBiz reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, third parties, or the integrity of the Service, or for any other reason at our sole discretion. You may terminate your account at any time by contacting support@onebiz.com.au.
13Changes to Terms
OneBiz reserves the right to modify these Terms at any time. Material changes will be notified via in-app notification or email at least 14 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
14Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising under or in connection with these Terms.
